Can an employee resign during his probationary period without notice?
I am currently in a probationary period(6 months) without a compensation in a small organization. I was given the offer letter which states that i need to give 1 month of notice before leaving the company. have completed 4 months as of now and have now got very good offer from an other company. My doubt is, can i resign without giving the 1 month notice as mentioned in the offer letter? are the rules stated in the offer letter applicable to the employees under probation? somebody please clarify.

Generally in the probationary period the employee can leave without notice and the employer can terminate without notice. That’s your chance to get to know each other and if you decide you want to move on, that’s your time to do it.

If you have a problem with your lawyer’s employee?
I have a lawyer who is handling my accident case. Lawyer’s employee has written a rough draft of my demand letter to seek my compensation. However, I notice that the employee has missed around $3000 worth of my medical expenses.
Clearly, I’m going to point this out to the lawyer’s assistant, but how do I express my disappointment in this kid of huge inaccuracy? I feel as though the lawyer should apologize and maybe they should compensate me for making this kind of inaccuracy. (Since I’m paying the lawyer, it should not be my job to check their work. In doing so, spending several hours)

As others have said, you are being unrealistic. Even if you are paying your lawyer (and I assume you are not doing so now, but any fee will come out of a verdict or settlement if there is one), lawyers have their clients review this kind of correspondence precisely because it is their job to check for this kind of thing. The client will undoubtedly know his details better than the lawyer will so it is in fact up to the client to check the letter for factual inaccuracies. Just point it out to the lawyer and his employee and review the next draft of the letter. Do it politely. It was just a mistake and it cost you nothing.

Seal Forwarding Scam?
I got a job through Craigs list, it was for a company called Seal Forwarding Inc, they have a website, they sent me a package -a digital camera-. I want to know if they’re legit, any advice all they asked for was my name and address nothing else, i talked to them on the phone, here’s the agreement

EMPLOYMENT AGREEMENT
This General Employment Agreement (“Agreement”) is made and effective this 04/07/2010,
BETWEEN:
(Your full name)
(the “Employee“), an individual with his current accommodation:
(Your address)
(the “Employee’s address”).
AND:Seal Forwarding, Inc (the “Employer”), a corporation organized and existing under the laws of New York (hereby referred as NY), with its head office located at 1078 Route 112 #105, Port Jefferson Station, NY 11776.
RECITALS
A.Employer is engaged in the business of mail forwarding service, and maintains a branch office at 1078 Route 112 #105, Port Jefferson Station, NY 11776.
B.Employee is willing to be employed by employer, and employer is willing to employ employee, on the terms, covenants, and conditions set forth in this Agreement.
In consideration of the matters described above, and of the mutual benefits and obligations set forth in this Agreement, the parties agree as follows:
1.EMPLOYMENT
Employer employs, engages, and hires employee as an AGENT to RECEIVE LETTERS, PARCELS and PACKAGES, REPACK, CONSOLIDATE, VERIFY THEM AND FORWARD THEM TO THEIR LEGAL OWNERS.
A.Employee accepts and agrees to such hiring, engagement, and employment, subject to the general supervision and pursuant to the orders, advice, and direction of employer.
B.Employee shall perform such other duties as are customarily performed by one holding such position in other, same, or similar businesses or enterprises as that engaged in by employer, and shall also additionally render such other and unrelated services and duties as may be assigned to HIM OR HER from time to time by employer.
C.Employee agrees that HE OR SHE must forward the parcel, package or envelope, received from a client for the maximum deadline of 3 (three) days AFTER employee shall receive the appropriate information for forwarding from Employer.
D.Employee agrees that in case if HE OR SHE was unable to receive the parcel, package or envelope at HIS OR HER house, for any reasons, HE OR SHE must visit the nearest branch office of USPS, UPS, FedEx or other delivery company.
2.BEST EFFORTS OF EMPLOYEE
Employee agrees that HE OR SHE will at all times faithfully, industriously, and to the best of HIS OR HER ability, experience, and talents, perform all of the duties that may be required of and from HIM OR HER pursuant to the express and implicit terms of this Agreement, to the reasonable satisfaction of employer. Such duties shall be rendered at Employee’s address and at such other place or places as employer shall in good faith require or as the interest, needs, business, or opportunity of employer shall require.
3.TERM OF EMPLOYMENT
The term of this Agreement shall be a period of 1 (ONE) years, commencing 04/07/2010, and terminating 04/07/2011, subject, however, to prior termination as provided in this Agreement. At the expiration date of 04/07/2011, this Agreement shall be considered renewed for regular periods of one year, provided neither party submits a notice of termination.
4.COMPENSATION OF EMPLOYEE
Employer shall pay the employee, and the employee will accept payments from the employer, for employee’s services under this Agreement, with the compensation at the rate of US$30.00 (thirty USD) per parcel and US$10.00 (ten USD) per letter, which employee will forward to the clients. Employee will be paid out on the specific date, calculated by the company. The overall payment will be processed, each time employee processes 20 parcels. Overall payment will be processed using these payment options: Wire Transfer, Western Union, Money Gram or PayPal (payment options will be negotiated with the employee). Such payment rules are applicable, as long as this Agreement is in force.
Employer shall pay employee and employee shall accept from employer additional bonus of US$15.00 (fifteen USD) per parcel that will be forwarded on the day of receiving of the appropriate information for forwarding.
Employer shall pay employee and employee shall accept from employer fixed monthly rate of US$200.00 (two hundred USD).
In case if the employee was unable for any reasons (excluding Force Majeure situations) to fulfill the requirements from Part One (Employment Details) of this legal document, payment for the parcel shall be lowered up to 50%.
Employer shall reimburse employee for all necessary expenses incurred by employee while traveling pursuant to employer’s directions.
5.TERMINATION DUE TO DISCONTINUANCE OF BUSINESS
